Terms of Service

This wording was written from how the platform actually works and is a starting point, not legal advice. It should be checked by someone qualified before you rely on it. A super admin can edit it, and can remove this notice, under Settings → Website.
These terms govern your use of the GotiSMS platform. Please read them — the section on consent in particular, because it is the one that gets accounts suspended.
Who these terms are between
GotiSMS (“we”, “us”) provides a bulk SMS and API platform. These terms are between us and the business that holds the account (“you”).
By creating an account you accept them. If you are accepting on behalf of a company, you confirm you are authorised to do so.
Your account
Accounts are reviewed by hand before they are activated. We may decline an application, and we will tell you why.
The details you give us must be accurate and kept up to date. You are responsible for everything done through your account, including by sub-users you create and by anything using your API credentials. Tell us straight away if you think someone else has your credentials.
Consent — the rule that matters most
You may only send messages to people who have agreed to receive them from you. That agreement must be something you can show us if we ask.
A purchased, scraped, rented or inherited list is not consent. Neither is a business card, nor a number given for a different purpose.
Every marketing message must offer a way to stop. When someone opts out you must stop sending to them, and you must not put them back on a list by re-importing an older file.
What you may not send
No message that is unlawful, fraudulent, or designed to deceive the person receiving it — including messages that imitate a bank, an operator, a government body or us.
No phishing, no malware links, no lottery or prize scams, no unlicensed financial or gambling promotions, no adult content, and nothing that harasses or threatens.
Nothing that breaches Bangladesh law or the rules of the Bangladesh Telecommunication Regulatory Commission (BTRC) or the mobile operators. Operator rules change, and we will pass on changes that affect you.
Sender IDs
A masked sender ID must be approved before it can be used, and each mobile operator registers it separately. Approval on one network does not mean it works on all of them — your account shows which networks a sender ID is live on.
You must have the right to use the name you ask for. We may refuse or withdraw a sender ID that impersonates someone else or that an operator rejects.
Prices, your wallet and payment
The platform is prepaid. You add funds to a wallet and each message is charged against that balance.
Prices are per message segment and depend on the destination operator and the message category. A message longer than one segment, or containing any non-GSM character such as Bengali, costs more than one segment — the dashboard shows the exact cost before you send, calculated by the same code that charges you.
Funds are reserved when a campaign is queued and settled when the messages are done: you are charged for what was actually sent, and the rest is released back to your balance. Wallet funds are for buying messages and are not refundable in cash, except where the law requires otherwise.
Delivery
We pass your messages to mobile operators and aggregators. We cannot guarantee that a message arrives, or when — that depends on the operator, the handset and the network, and none of them is under our control.
We record the operator's own delivery report against each message and show it to you unchanged. We do not resend a failed message automatically; sending it again is your decision and is charged again.
Service availability
We aim to keep the platform running continuously, but we do not promise uninterrupted service. We carry out maintenance, and we will give notice of planned work where we can.
We may suspend an account immediately, without notice, if we believe it is being used to send messages that break these terms, if an operator requires it, or if we are ordered to by a regulator or a court. We will tell you why as soon as we are able.
Ending the agreement
You may close your account at any time. We may end this agreement with 30 days' notice, or immediately for a serious or repeated breach.
When an account closes we stop accepting new messages from it. Your data is kept or deleted as described in the Privacy Policy.
Our liability
Nothing here limits liability that cannot be limited by law.
Otherwise, we are not liable for lost profits, lost business, lost data or indirect losses; and our total liability to you in any twelve-month period is limited to the amount you paid us in that period.
You are responsible for the content of your messages and for having consent to send them. If a claim is made against us because of what you sent, you agree to cover the cost of it.
Changes to these terms
We may change these terms. If a change materially affects you we will give notice by email to the address on your account before it takes effect.
The date at the top of this page is when it last changed. Continuing to use the platform after that date means you accept the current version.
Law and disputes
These terms are governed by the laws of Bangladesh, and the courts of Bangladesh have jurisdiction.
